JSC "National Infocommunication Holding "Zerde" (hereinafter – the Holding), defined by the National Institute for Development in the Field of Information and Communication Technologies (hereinafter – ICT) by Decree of the Government of the Republic of Kazakhstan dated November 11, 2016 No. 695, in order to study the market for the formation and development of the regulatory and methodological framework for activities in the ICT industry, invites you to present their interest in assisting the Holding, as a potential co-executor, in the preparation of the draft Concept of the draft Digital Code of the Republic of Kazakhstan (hereinafter referred to as the Service).

JSC "National Infocommunication Holding "Zerde" (hereinafter – the Holding), defined by the National Institute for Development in the Field of Information and Communication Technologies (hereinafter – ICT) by Decree of the Government of the Republic of Kazakhstan dated November 11, 2016 No. 695, in order to study the market for the formation and development of the regulatory and methodological framework for activities in the ICT industry, invites you to present their interest in assisting the Holding, as a potential co-executor, in the preparation of the draft Concept of the draft Digital Code of the Republic of Kazakhstan (hereinafter referred to as the Service).

          The estimated Service delivery period will take no more than 8 months.

          The Organization, as part of the provision of the Service, must carry out the following activities:

1)   analysis of the current legislation in order to identify gaps, contradictions, multiplicity of acts regulating similar public relations in the following aspects: information (duties, rights and restrictions related to the life cycle of information, including the Internet and social networks); mechanisms for protecting information that harms health and development; rights of citizens in the digital environment; intellectual property law and issues; international experience in managing/implementing digitalization processes, advanced trends and digitalization tools; regulation of the use of digital technologies in various fields of economics and subject areas (principles, ethics, IR services, applied technologies); digital stability and security of critical information and communication infrastructure facilities; communications and telecommunications (construction and use of networks, distribution and use of limited resources, interconnections and non-discriminatory access, network neutrality, rights and obligations of users, providers and operators); international cooperation and creation of conditions for international information exchange;

2)   conducting an analysis of international legislation and on the following aspects: information (duties, rights and restrictions related to the life cycle of information, including the Internet and social networks); mechanisms for protecting information that harms health and development; rights of citizens in the digital environment; intellectual property law and issues; international experience in managing/implementing digitalization processes, advanced trends and digitalization tools; regulation of the use of digital technologies in various fields of economics and subject areas (principles, ethics, IR services, applied technologies); digital stability and security of critical information and communication infrastructure facilities; communications and telecommunications (construction and use of networks, distribution and use of limited resources, interconnections and non-discriminatory access, network neutrality, rights and obligations of users, providers and operators); international cooperation and creation of conditions for international information exchange;

3)    analysis of the international experience of digitalization of economic sectors;

4)   assessment of the impact of systematization of the legislation of the Republic of Kazakhstan on the existing mechanisms of legal regulation of public relations on the aspects specified in paragraphs 1), 2), 3);

5)   development of a Regulatory Policy Advisory Document to the draft Digital Code of the Republic of Kazakhstan in accordance with the Rules of Legislative Work of the Government of the Republic of Kazakhstan approved by the Decree of the Government of the Republic of Kazakhstan dated December 29, 2016 No. 907;

6)   development of proposals for the draft Concept of the draft Digital Code of the Republic of Kazakhstan based on the results of the implementation of paragraphs 1) to 5).

          Criteria for an organization to provide Services:

1) at least 5 years of local and international experience in providing services for the analysis of gaps and conflicts in legislation, the development of regulatory legal acts;

2)   at least 3 years of experience in the development and promotion of regulatory legal acts in the field of entrepreneurship;

the presence in the staff of at least 3 legal specialists in the following areas: telecommunications and communications/information technology/information security.
